This document governs your use of the Pourtrait mobile application and related services.
1. Introduction and Acceptance of Terms
Welcome to Pourtrait. These Terms and Conditions of Use ("Terms") form a legally binding agreement between you and Cuvee Labs ("we", "us", or "our") governing your access to and use of the Pourtrait mobile application and any related services (collectively, the "Services"). By downloading, installing, or using Pourtrait, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Services. These Terms apply to all users, including free (Enthusiast) and paid (Connoisseur) tier users. Note: These Terms are intended to be read alongside our Privacy Policy, which is available at pourtrait.wine/privacy and within the app.

3. Eligibility and Age Requirements
Pourtrait is a service involving alcohol-related content and recommendations. To use the Services, you must meet the following minimum age requirements: - European Union and United Kingdom: You must be at least 18 years of age. - United States of America: You must be at least 21 years of age. - All other regions: You must meet the minimum legal drinking age in your country of residence. By creating an account, you confirm that you meet the applicable age requirement for your region. We reserve the right to suspend or terminate any account where we have reason to believe an age requirement has not been met. Pourtrait is not intended for use by minors. If you are the parent or guardian of a minor who has used the app without authorisation, please contact us at hello@pourtrait.wine.
4. Account Registration
To access Pourtrait, you must create an account. You may register using your email address or via a supported third-party authentication provider (currently Google, Apple, or Microsoft). By registering, you agree to: - Provide accurate, current, and complete information during registration; - Maintain and promptly update your account information; - Keep your login credentials confidential and not share them with others; - Accept responsibility for all activities that occur under your account; - Notify us immediately at hello@pourtrait.wine if you become aware of any unauthorised use of your account. We reserve the right to refuse registration or cancel accounts at our discretion, including where we reasonably believe a user is under the applicable minimum age. Offline access is not currently available. An internet connection is required to use the Services.
5. Description of the Services
Pourtrait is a personal AI-powered wine companion application. The Services currently include, but are not limited to: 5.1 Taste Profile and AI Recommendations An AI-generated personalised wine taste profile, built from a guided quiz and refined by your ratings, scans, and cellar activity. A shareable "Pourtrait" preference card summarising your wine preferences. Personalised wine recommendations generated by our AI based on your taste profile. 5.2 Label and Menu Scanning Label recognition (OCR) technology to identify wines from bottle labels. Menu scanning to identify and retrieve wine details from restaurant wine lists. Wine details including tasting notes, critic scores, food pairing suggestions, and ageing potential. 5.3 Cellar Management Tools to add, organise, and track your wine collection. Cellar value estimation, consumption tracking, and cellar analysis. Drink-window alerts and cellar import functionality. 5.4 Food and Wine Pairing AI-powered food and wine pairing suggestions tailored to your taste profile and cellar contents. 5.5 Wine Discovery Discovery features to explore wines across all major styles: red, white, sparkling, rosé, orange, fortified, and dessert wines, as well as fortified wine products including grappa and wine liqueurs. We may add, modify, or remove features at any time. Where a material change affects paid subscribers, we will provide reasonable advance notice.
6. Subscription Plans and Billing
6.1 Subscription Tiers Pourtrait is free to download and offers two service tiers: - Enthusiast (Free): Access to core features of the app at no charge. - Connoisseur (Paid): Full access to all features, including advanced AI recommendations, enhanced cellar analysis, and premium discovery tools. 6.2 Subscription Billing and Management Connoisseur subscriptions are available on a monthly or annual basis and billed through your chosen platform or provider: - Apple users: Billing is managed by Apple via In-App Purchase. Your subscription will automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. - Google Play users: Billing is managed by Google via Google Play Billing. Your subscription will automatically renew unless cancelled before the renewal date. - Website subscriptions: If purchased directly through the Pourtrait website, billing is managed by our third-party payment processor. Your subscription will automatically renew at the end of each billing period unless cancelled at least 72 hours before the renewal date via your account settings on the website. By starting a paid subscription, you authorise the relevant platform provider to charge the applicable subscription fee to your payment method on a recurring basis. We reserve the right to change prices; we will give you reasonable advance notice of any price change before it takes effect. 6.3 Free Trials We may from time to time offer free trial periods for the Connoisseur tier. If you do not cancel before the end of the trial, you will be charged the applicable subscription fee.
7. Cancellation and Refunds
7.1 Cancellation You may cancel your Connoisseur subscription at any time through your platform account settings: - Apple: Settings > [Your Name] > Subscriptions > Pourtrait > Cancel Subscription. - Google Play: Google Play Store > Account > Subscriptions > Pourtrait > Cancel. Cancellation takes effect at the end of the current billing period. You will retain access to Connoisseur features until your paid period expires. 7.2 Refunds As payments are processed by Apple or Google, refund requests are governed by their respective refund policies: - Apple: Refund requests must be submitted via reportaproblem.apple.com or through Apple Support. - Google Play: Refund requests may be submitted via the Google Play Help Centre. We are unable to process refunds directly. 7.3 EU and UK Consumers — Right of Withdrawal If you are a consumer resident in the European Union or the United Kingdom, you have a statutory right to withdraw from a purchase within 14 days of the transaction date. By subscribing and accessing paid features immediately, you acknowledge that you are requesting immediate commencement of the service and that your right of withdrawal may be limited. This does not affect your statutory rights in relation to defective services.
8. User Content and Community Ratings
8.1 Your Private Content Tasting notes, personal ratings, cellar contents, and other data you enter into the app are private to your account. 8.2 Community Ratings Your individual wine ratings may be aggregated with those of other users to produce an anonymised community average rating. Your individual rating is never attributed to you or displayed to other users. 8.3 Your Pourtrait Profile Card Your personalised Pourtrait preference card is private by default. If you choose to share it, you do so voluntarily and at your own discretion. 8.4 Licence to Us By submitting content to the Services, you grant Cuvee Labs a non-exclusive, worldwide, royalty-free licence to use, process, and store that content solely for the purposes of providing and improving the Services. The licence terminates when you delete your account or specific content, except where content has been anonymised and aggregated. 8.5 Responsibility for Content You are solely responsible for any content you submit. You must not submit content that is unlawful, defamatory, obscene, or that infringes the rights of any third party.
9. Acceptable Use
You agree to use Pourtrait only for lawful purposes and in accordance with these Terms. You must not: - Use the Services in any way that violates applicable laws or regulations; - Use the Services if you do not meet the applicable minimum age requirement; - Attempt to gain unauthorised access to any part of the Services or other users' accounts; - Scrape, crawl, or systematically extract data without our prior written consent; - Introduce viruses, trojans, worms, or other malicious code; - Reverse engineer, decompile, or disassemble any part of the app; - Use the Services to transmit unsolicited communications; - Impersonate any person or entity; - Attempt to circumvent any security or access control mechanism. We reserve the right to investigate suspected violations and to suspend or terminate access.
10. Intellectual Property
All content, features, design, software, trademarks, and other materials comprising the Pourtrait application are owned by or licensed to Cuvee Labs and are protected by applicable intellectual property laws. These Terms do not grant you any right, title, or interest in any of our intellectual property. Third-party wine data, critic scores, and wine descriptions accessed via the Services may be subject to third-party intellectual property rights.
11. AI Features and Accuracy Disclaimer
Pourtrait uses artificial intelligence to generate personalised wine recommendations, taste profiles, food pairings, and related insights. You acknowledge and agree that: - AI-generated recommendations may not always reflect your actual preferences; - Wine details, critic scores, and tasting notes are provided for informational purposes only and may contain inaccuracies; - Label and menu scanning results depend on image quality and database completeness; - Drink-window recommendations are estimates only; - No content within the Services constitutes professional wine advice. We continually work to improve accuracy, but we make no warranty that the Services are free from errors.
12. Third-Party Services and Integrations
12.1 Third-Party Services Pourtrait integrates with third-party services. Your use of those services is governed by their respective terms and privacy policies. Current integrations include: - Apple In-App Purchase: Subscription billing for iOS users. Governed by Apple's Media Services Terms and Conditions. - Google Play Billing: Subscription billing for Android users. Governed by Google's Terms of Service. - Authentication Providers: Google, Apple, and Microsoft authentication. Governed by the respective provider's terms. - AI and Wine Recognition Providers: We use third-party AI service providers for wine recognition and recommendation features. Only the minimum necessary data is transmitted to these providers. We are not responsible for the content, privacy practices, or conduct of any third-party services. 12.2 Health, Allergen, and Consumption Disclaimer The Services are provided for entertainment and informational purposes only. By using the Services, you acknowledge: - Pourtrait does not provide medical, dietary, or health advice. - Wine products may contain allergens including sulfites, egg whites, milk proteins, or gluten. Our AI does not reliably track or filter for allergens. - You are solely responsible for reviewing physical labels for allergen declarations. - Cuvee Labs promotes responsible consumption. Our recommendations must not be construed as encouragement to consume alcohol in excess. To the maximum extent permitted by law, Cuvee Labs disclaims all liability for adverse health events resulting from products recommended or discovered through the Services.
13. Service Availability
We aim to provide continuous access to the Services, but we do not guarantee uninterrupted, error-free, or secure access. The Services may be temporarily unavailable due to scheduled maintenance, technical failures, or circumstances beyond our reasonable control. The Services currently require an active internet connection. Offline functionality is planned for a future release. We reserve the right to modify, suspend, or discontinue the Services at any time. Where we discontinue the Services permanently, we will provide paid subscribers with reasonable advance notice and a pro-rata refund where applicable.
14. Disclaimer of Warranties
To the fullest extent permitted by applicable law, the Services are provided "as is" and "as available", without warranties of any kind, either express or implied. We do not warrant that the Services will meet your specific requirements, be uninterrupted, timely, secure, or error-free, or that any results will be accurate, reliable, or complete. Nothing in these Terms excludes or limits our liability for fraud, fraudulent misrepresentation, willful misconduct, gross negligence, death or personal injury caused by our negligence, or any other liability that cannot be excluded under applicable law. For EU and UK consumers: The above disclaimers do not affect your statutory rights under applicable consumer protection legislation.
15. Limitation of Liability
To the fullest extent permitted by applicable law, Cuvee Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, any loss of profit, revenue, data, goodwill, or business opportunity, or decisions made in reliance on AI-generated content. Our total aggregate liability shall not exceed the total fees paid by you in the twelve (12) months preceding the event giving rise to the claim. Nothing in these Terms excludes or limits our liability for fraud, willful misconduct, gross negligence, or death or personal injury caused by our negligence. For EU and UK consumers: These limitations apply only to the extent permissible under applicable consumer protection laws.
16. Indemnification
You agree to indemnify, defend, and hold harmless Cuvee Labs from and against any claims, liabilities, damages, losses, costs, or expenses arising from: - Your use of the Services in breach of these Terms; - Your violation of any applicable law or regulation; - Any content you submit that infringes a third party's rights; - Your misrepresentation of your age or eligibility.
17. Termination
17.1 Termination by You You may close your account at any time by using the account deletion feature within the app or by contacting us at hello@pourtrait.wine. 17.2 Termination by Us We may suspend or terminate your account immediately and without prior notice if you breach these Terms, we are required to do so by law, we believe you are below the applicable minimum age, or your conduct poses a risk to the Services or other users. 17.3 Effect of Termination Upon termination, your right to use the Services ceases immediately. Where termination is by us without cause, we will provide a pro-rata refund of prepaid subscription fees. Where termination is due to your breach, no refund will be due. Sections 8.4, 10, 11, 14, 15, 16, and 18 shall survive termination.
18. Governing Law and Dispute Resolution
18.1 Governing Law These Terms are governed by and construed in accordance with Swiss law, without regard to its conflict of law provisions. 18.2 Mandatory Consumer Protections If you are a consumer resident in the European Union, the United Kingdom, or Switzerland, you also benefit from the mandatory consumer protection provisions of your country of residence. 18.3 Dispute Resolution We encourage you to contact us first at hello@pourtrait.wine. We will endeavour to resolve complaints informally within 30 days. If a dispute cannot be resolved informally, the courts of competent jurisdiction at our place of business shall have exclusive jurisdiction, subject to mandatory consumer protection laws. EU consumers may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
19. Changes to These Terms
We may update these Terms from time to time. When we make changes, we will update the "Effective Date" and notify you of material changes via in-app notification or email. Your continued use of the Services after updated Terms take effect constitutes your acceptance. If you do not agree, you must stop using the Services. For significant changes affecting paid subscribers, we will give at least 30 days' advance notice.
